ÖZ
Temel ve en gerçek anlamda varoluş bir canlının var olduğunu ifade eder. Canlılar içeresinde insan varlığı değerini hak ve bütünlük içerisinde kendisini saklar. İşte bu süreç onun yaşam alanında neslini sürdürmeyi hedef kılar. Var olmak genellikle insanın kendi varlığını anlamlandırma ve yaşamın anlamını keşfetme çabasıyla ilgilenir. Diğer bir taraftan ise felsefi veya psikolojik bir perspektiften ele alınan, bireyin varoluşu, anlam arayışı, özgürlük, sorumluluk ve yaşamın anlamı gibi konuları içeren bir kavramdır. İnsan yaşamının devamı ihtiyaçlarını karşılama ve bu hiyerarşik süreçte haklarını aramayı hedefler. Bu hiyerarşik yaşam prosesi onun varlığını sürdürmeyi sağlayan temel ihtiyaçları ifade eder. Bu konuda en gerçekçi kabul görüş ise Abraham Maslow” un “İhtiyaçlar Hiyerarşisidir. Kendi türü içerisinde en çok ve sert yaşam mücadelesi veren canlı insandır. Tehdit unsuru, yok olma tehlikesi ile türüne zarar verende kendisidir. İhtiyaçlar bağlamında hak ve özgürlüğün temeli ise hak kavramıdır. “Hak" kavramı, bir kişiye veya topluluğa, hukuki, etik veya toplumsal bağlamda tanınan veya verilen bir ayrıcalığı veya yetkiyi ifade eder. Varlığını koruması hak temelli yaşam sorunsalı bu paradoksal süreçte bazı düzenlemeleri de beraberinde getirmektedir. Kronolojik tarihsel süreç, insanın doğuştan hak ettiği ve hiçbir şekilde devredilmeyen kabul gören varlık haklarını elde etmeyi başarmıştır. Haklar ve insan hakları, toplumların temel değerlerini ve normlarını şekillendiren önemli kavramlardır. İşte bu şekilde normal şartlar altında devam etmesi istenen bu süreç ihlaller ve dayatmalar ile darboğaza girebilmektedir. İnsanın en temel hakkı olan yaşama hakkını garantiye olmak ve sürdürülebilirliğinin devamı için tüm Dünya ulusları ortak bir deklarasyon ile bunu imza altına almışlardır. Bu çalışmada, olağanüstü hâl durumlarında karşılaşılan insan hakları ihlalleri konusunda bir analiz yapılacaktır.

ABSTRACT
Existence in the basic and most real sense means that a living being exists. Among living beings, the human being preserves its value in right and integrity. This process makes it a goal to continue its generation in the field of life. Existence is generally concerned with human beings' efforts to make sense of their existence and to discover the meaning of life. On the other hand, it is a concept that is addressed from a philosophical or psychological perspective and includes issues such as the existence of the individual, the search for meaning, freedom, responsibility, and the meaning of life. The continuation of human life aims to meet its needs and to seek its rights in this hierarchical process. This is because this hierarchical life process expresses the basic needs that ensure its survival. The most realistic view on this subject is Abraham Maslow's "Hierarchy of Needs". Man is the creature that struggles the most and hardest for survival within his own species. It is he who harms his species with the element of threat, the danger of extinction. The basis of rights and freedom in the context of needs is the concept of right. The concept of "right" refers to a privilege or authority granted or granted to a person or a community in a legal, ethical, or social context. The problematic of rights-based life brings along some regulations in this paradoxical process. The chronological historical process has succeeded in obtaining the recognized rights to existence that human beings deserve from birth and cannot be transferred in any way. Rights and human rights are important concepts that shape the fundamental values and norms of societies. In this way, this process, which is intended to continue under normal conditions, can be bottlenecked by violations and impositions. To guarantee the most fundamental human right, the right to life, and to ensure its sustainability, all nations of the world have signed a joint declaration. This article analyzes human rights violations in states of emergency.
